Is pnForm coded to handle the fieldset and legend tags? or do I just put the straight HTML in the pnForm templates?

The latter one should be the way to go
Since a fieldset has no own functionality, there are no plugins for it at the moment AFAIK. Can be that there will be block plugins (like for the form itself) in future.
